Clients are responsible for providing accurate and timely information, content, materials, approvals, and access necessary to complete a project.
This may include:
Business information
Website content
Logos and branding materials
Images and graphics
Domain and hosting access
Existing website access
Third-party platform access
Feedback and approvals
Clients are responsible for ensuring that any content, images, trademarks, logos, documents, or other materials they provide to Digital Solutionsx may legally be used for their website.
Delays in providing required information, materials, access, or approvals may affect project timelines.
Where website access credentials are provided to Digital Solutionsx, such credentials will be used only as reasonably necessary to perform the agreed services.
Clients are responsible for ensuring that they have authority to provide access to the website, hosting account, domain, or other third-party platform.
Digital Solutionsx is not responsible for issues caused by inaccurate credentials, unauthorized third-party access, hosting restrictions, domain issues, or changes made by the client or another third party.
Digital Solutionsx will perform the services according to the agreed project scope.
Requests that fall outside the original scope may require additional fees, additional time, or a separate agreement.
Changes to project requirements after work has begun may affect the estimated completion date and project cost.
Digital Solutionsx may request written confirmation before beginning substantial additional work.
Fees for services will be communicated to the client before or during the project.
Unless otherwise agreed in writing:
The client is responsible for paying the agreed service fees.
Additional services outside the agreed scope may be billed separately.
Third-party costs, including hosting, domain registration, premium themes, plugins, software, applications, or other services, may be charged separately.
Payments made to third-party providers may be subject to those providers’ own terms and refund policies.
Any promotional pricing, introductory pricing, or trial offer is subject to the specific terms communicated at the time of the offer.
The number of revisions included in a project will depend on the agreed scope.
Clients are responsible for reviewing designs, content, functionality, and other deliverables and providing timely feedback.
Once a deliverable has been approved, additional changes may be treated as new work and may be subject to additional charges.
Digital Solutionsx will make reasonable efforts to complete projects within the agreed or estimated timeframe.
Project timelines may be affected by:
Delays in receiving client materials
Delays in receiving approvals
Changes to project requirements
Third-party hosting or software issues
Domain or DNS issues
Technical problems outside our reasonable control
Other circumstances beyond our control
Estimated timelines are not guaranteed unless expressly agreed in writing as guaranteed deadlines.
A website may use third-party services, platforms, plugins, themes, hosting providers, payment processors, analytics services, or other technologies.
Digital Solutionsx does not control third-party services and cannot guarantee their availability, security, functionality, pricing, or continued operation.
Clients are responsible for complying with the terms and policies of third-party services they use.
Unless otherwise agreed in writing, Digital Solutionsx retains ownership of its pre-existing tools, processes, templates, systems, frameworks, code libraries, techniques, and other materials used to provide services.
Upon full payment of applicable project fees, the client will receive the agreed website deliverables and rights to use the completed website as specified in the project agreement.
Third-party software, themes, plugins, fonts, images, stock assets, and other third-party materials remain subject to their respective licenses and terms.
The client retains responsibility for content, materials, trademarks, images, text, and other information supplied to Digital Solutionsx.
The client represents that they have the necessary rights, permissions, and licenses to use materials they provide.
Digital Solutionsx is not responsible for claims arising from unauthorized or unlawful materials supplied by the client.
The client is responsible for ensuring that the final website complies with laws and regulations applicable to their business, industry, location, and activities.
This may include privacy policies, terms and conditions, cookie notices, accessibility requirements, industry-specific disclosures, advertising requirements, and other legal obligations.
Digital Solutionsx may assist with website implementation but does not provide legal advice.
Clients should consult a qualified attorney or other appropriate professional regarding legal compliance.
Digital Solutionsx will make reasonable efforts to deliver functional websites according to the agreed project requirements.
However, Digital Solutionsx does not guarantee that a website will be completely free from bugs, vulnerabilities, downtime, compatibility issues, or interruptions.
Website performance may depend on hosting providers, third-party services, internet connectivity, plugins, themes, browsers, devices, and other factors outside our control.
Either party may terminate a project according to the terms agreed upon for that project.
If a client terminates a project after work has begun, the client may remain responsible for fees relating to work already completed, approved expenses, third-party costs, and other amounts properly incurred before termination.
Digital Solutionsx may suspend or terminate services if a client fails to make required payments, provides unlawful content, misuses services, or materially breaches these Terms.
By providing your mobile phone number, you agree to receive text messages from Digital Solutionsx at the number provided, sent using an automated system. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for any delayed or undelivered messages. To the extent permitted by applicable law, the client agrees to indemnify and hold harmless Digital Solutionsx, its owners, employees, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from:
Content supplied by the client
Unauthorized use of third-party materials
Violation of applicable laws by the client’s website or business
Client’s misuse of the services
Client’s breach of these Terms
Digital Solutionsx will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet or telecommunications failures, hosting outages, third-party service interruptions, cyber incidents, government actions, labor disputes, or other circumstances beyond our reasonable control.
